Welcome to Fitties. These Terms of Service (“Terms”) govern your access to and use of fitties.com and all related services, subscriptions and purchases (collectively the “Service”). By accessing or using the Service, you agree to these Terms.

2. Definitions

  • “We,” “us,” “our” refers to Fitties and its corporate entity.
  • “User,” “Customer,” or “you” means any person using or purchasing through the Service.
  • “Products” means supplements and other goods available through the Service.
  • “Subscription” means a recurring auto-renewing order.
  • “Order” means a one-time purchase.

3. Use of the Service

You must be 18 years or older to use the Service or make purchases. The Service is for personal, non-commercial use. Unauthorized resale, reproduction, or distribution is prohibited.

4. Orders & Subscriptions

4.1 Orders

We may refuse or cancel Orders, including due to suspected fraud, abuse, or pricing errors. Once shipped, your Order cannot be modified.

4.2 Subscriptions & Auto-Renewal

By enrolling in a Subscription, you authorize us to automatically charge your payment method at each renewal interval until canceled. Pricing, frequency, and details are displayed at checkout and inside your customer account.

5. Payment & Billing

You agree to provide valid payment details. We reserve the right to cancel or suspend accounts for failed or disputed payments.

6. Shipping, Risk & Title Transfer

Title and risk transfer to you when the carrier receives the shipment.

8. Medical & Regulatory Disclaimer

Products sold via the Service are not intended to diagnose, treat, cure, or prevent any disease. Statements have not been evaluated by the Food & Drug Administration.

9. International Sales

International shipments may be subject to customs, duties, or import taxes. These costs are the responsibility of the customer.

10. Intellectual Property

All site content is owned by or licensed to Fitties and protected under intellectual property laws.

11. Prohibited Conduct

  • Illegal use or resale of the Service or Products
  • Reverse engineering Products
  • Automated scraping or extraction without permission
  • Providing false or misleading information

THE SERVICE AND PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTH PERIOD PRIOR TO THE CLAIM.

You agree to indemnify and hold Fitties harmless from claims related to your misuse of the Service or Products.

15. Arbitration & Class Action Waiver

Disputes will be resolved by binding arbitration administered by the AAA in Denver, Colorado. You waive rights to class action litigation.

16. Modifications to Terms

We may update these Terms at any time. Continued use constitutes acceptance.

18. Governing Law

Governed by Colorado law without regard to conflicting jurisdiction principles.

19. Severability

If any provision is invalid, the remainder of the agreement remains enforceable.
